Terms of use
Version of 30 October 2026
These terms of use (the “Terms”) govern access to and use of API Cinéma: the programming interface (REST API and MCP server), its documentation and the dashboard (together, the “Service”), published by Florian ARGAUD, entrepreneur individuel (EI), SIREN 512 931 304, 1553 route des Campings, 05600 Guillestre, France (the “Publisher”).
Any use of an API key means you accept the Terms in full. If you use the Service on behalf of a company or organisation, you represent that you are authorised to bind it, and “you” or the “Client” refers to that entity. This English text is a translation: the French version prevails.
1. Definitions
- “Account”: the client space opened by the Publisher in the Client’s name, giving access to the dashboard.
- “API Key”: the secret identifier (prefix
ac_live_) attached to the Account, which authenticates every request. - “Data”: any information returned by the Service (cinemas, films, showtimes, identifiers, metadata) and the database it is taken from.
- “Application”: the Client’s website, app or tool that consumes the Service, as described in its access request.
- “Quote”: the offer accepted by the Client, setting the price, quotas and authorised use. Together with the Terms it forms the contract; where they conflict, the Quote prevails.
- “Plan”: the offer subscribed online on the site (Free, Starter, Pro or Business), whose price, quotas, payment and cancellation are governed by the terms of sale.
2. Access and Account
The Account is created online, on the Free Plan, once the e-mail address is confirmed; it may also be opened by the Publisher on request, for an offer on Quote. The Publisher may turn down an access request without giving reasons.
- One Account per Client. Opening several Accounts for the same person, company or group, directly or through someone else, is forbidden without the Publisher’s written consent.
- The information provided (identity, company, intended use) must be accurate and kept up to date. Any material change of use (new Application, audience or volume out of proportion with the request) must be reported and approved before it happens.
- The Client alone is responsible for its credentials and for every request made with its API Keys, including by a third party.
3. API Keys
- API Keys are strictly personal to the Client: they may not be lent, shared, assigned or sold.
- They must stay server-side. Embedding them in code run on the end user’s device (web page, mobile or desktop app, extension) or publishing them (code repository, forum, screenshot) is forbidden.
- The Client reports any leak or suspicious use without delay, and revokes the key from the dashboard.
- The Publisher may revoke, or require the renewal of, a key that is exposed or used abnormally, at any time.
4. Licence
For the term of the contract, the Publisher grants the Client a non-exclusive, non-transferable, non-sublicensable and revocable right to query the Service and display the Data in its Application, for the declared and approved use.
The Client may cache the Data for as long as the Application needs to work properly, and keeps it up to date as the documentation describes (incremental sync). All other rights are reserved.
The Free plan is limited to trials and non-commercial use (personal, educational, research or non-profit project without revenue). Commercial use includes displaying or exploiting the Data in an Application that generates revenue, directly or not (sales, subscriptions, advertising, work for a client), or that serves a business, a cinema’s, exhibitor’s or agency’s website included. Such use requires a paid plan or a Quote.
5. Quotas and technical limits
Each API Key has a maximum number of requests per minute; an Account may also have a weekly quota, shared by all its keys, and a maximum number of keys. These limits are set by the subscribed Plan or by the Quote, and described in the documentation.
- Limits apply per Client: they cover every Account and API Key it controls, directly or not.
- Past a limit, the Service answers
429 Too Many Requests. The Client must then wait for the delay given byRetry-Afterbefore retrying, and not replay refused requests in a loop. - A need for more volume is handled by asking the Publisher (a ticket from the dashboard), never by working around the limits.
6. Prohibited use and circumvention
The following are forbidden, whether attempted or carried out, by the Client or by a third party it lets act:
- circumventing, disabling or evading quotas, rate limits or security measures: multiplying Accounts or API Keys, spreading requests over keys of different Accounts, using another client’s key, rotating IP addresses or proxies, false identity;
- reselling, renting, sublicensing or making access to the Service available to third parties, in particular by exposing it through a relay, mirror, proxy or API that reproduces all or part of it;
- repeated and systematic extraction or reuse of the Data beyond the declared use, in particular to rebuild all or part of the Publisher’s database, distribute it in bulk (export, file, dataset) or feed a competing service;
- using the Data to train or evaluate an artificial intelligence model, without the Publisher’s written consent;
- reaching the Service or the Data other than through the authenticated API: automated extraction (scraping) of the website, documentation or dashboard, exploiting a flaw, accessing undocumented resources;
- load testing, probing, scanning or attacking the Service, disrupting it, or reverse engineering it beyond what the law allows;
- using the Data unlawfully, misleadingly or in breach of third-party rights, or presenting it as supplied or guaranteed by the cinemas, distributors or the Publisher.
7. Data and intellectual property
The Service, its documentation and its database belong to the Publisher. The database, whose collection, verification and daily update represent a substantial investment, is protected by the database maker’s right (articles L.341-1 et seq. of the French Intellectual Property Code). Any extraction or reuse not allowed by the Terms infringes it.
The Data comes from the programmes published by the cinemas and from third-party sources (for example TMDB for film metadata). Some of it remains subject to the terms of its source, which the Client follows when displaying it, attribution included.
Showtimes may be changed or cancelled by the cinemas at any time. The Client does not present the Data as final and invites its users to check with the cinema.
8. Monitoring and action against abuse
To enforce the Terms and protect the Service, the Publisher records the use of every key (timestamp, endpoint, volume, IP address, user agent) and may analyse it to detect abnormal use.
On a breach of the Terms, or a serious suspicion of one, the Publisher may, depending on its severity and without any right to compensation or refund:
- send a warning and require compliance within a period it sets;
- lower quotas or revoke one or more API Keys;
- suspend the Account, immediately and without notice when the security or availability of the Service is at stake, or in case of circumvention or resale;
- terminate the contract and refuse any new request from the Client or related persons.
The Publisher also reserves the right to invoice, at the Quote’s rates, the usage obtained by circumvention, and to claim compensation for its full loss.
9. Availability and changes to the Service
The Publisher endeavours to keep the Service available and the Data up to date, with no obligation of result unless a service level is set by the terms of sale (Business plan) or written into the Quote. The Service may be interrupted for maintenance or in case of force majeure.
The Service evolves. Breaking changes go into a new API version; the previous version is deprecated with notice published in the documentation (“What’s new”).
10. Liability
The Service and the Data are provided as is. The Publisher guarantees neither their completeness nor their accuracy, and is not liable for the consequences of a wrong, changed or cancelled showtime.
The Publisher’s liability is limited to direct and foreseeable damage, up to the amounts paid by the Client in the twelve months before the event giving rise to it. The Client indemnifies the Publisher against any third-party claim related to its Application or to a breach of the Terms.
11. Term and termination
The contract runs for the term set in the Quote or, failing that, for an indefinite term. Either party may end it in writing, with the notice set in the Quote, without prejudice to section 8. A paid Plan is cancelled under the terms of sale; the Client may close their Account by asking through a ticket or by e-mail.
When the contract ends, the API Keys are disabled. The Client stops using the Data and deletes what it kept within 30 days.
12. Personal data
The Publisher processes Account data (name, email address, company) and usage logs to provide, bill and secure the Service and to enforce the Terms (legal basis: performance of the contract and legitimate interest). They are kept for the term of the contract then, for logs, 12 months at most, unless the law requires otherwise. You have the rights of access, rectification, erasure, objection and restriction, to exercise at contact@florianargaud.com, and may lodge a complaint with the CNIL.
The Service returns no personal data about the Client’s end users; the Client alone is responsible for the processing it carries out in its Application.
13. Changes to the Terms
The Publisher may change the Terms. Any material change is announced by email or on the dashboard at least 30 days before it takes effect, unless the law or the security of the Service requires otherwise. Continuing to use the Service after that date means acceptance; otherwise the Client may terminate.
14. Governing law and disputes
The Terms are governed by French law. Where translated, the French version prevails. Failing an amicable settlement, any dispute goes to the competent courts of the Publisher’s registered place of business, including for summary proceedings or with several defendants, subject to mandatory rules protecting consumers.
