Terms of sale

Version of 31 October 2026 — translation; the French version prevails.

These terms of sale (the “Terms of Sale”) apply to the API Cinéma plans subscribed online on api-cinema.com, sold by Florian ARGAUD, sole proprietor (entrepreneur individuel), SIREN 512 931 304, 1553 route des Campings, 05600 Guillestre, France (the “Publisher”).

Paid plans (Starter, Pro and Business) are for businesses only: the Client declares that they subscribe for the purposes of their trade, business or profession (company, freelancer, association, public body) and do not act as a consumer.

These Terms of Sale supplement the terms of use (the “Terms”), which govern the use of the Service and whose definitions apply here. Where they conflict on the price, payment or cancellation of a plan, these Terms of Sale prevail; an offer on quote remains governed by its Quote.

1. Plans

The Service is offered in the following plans, as described on the Pricing page of the site on the day of subscription:

  • Free: €0, 150 requests a week, 1 API Key, to try the Service or for non-commercial use (section 4 of the terms of use).
  • Starter: €12 a month, 10,000 requests a week, 3 API Keys.
  • Pro: €49 a month, 100,000 requests a week, 10 API Keys and a higher rate per key.
  • Business: €199 a month or €1,990 a year, 1,000,000 requests a week, 25 API Keys, the per-key rate of the Pro plan and the commitments of section 9.

Weekly quotas are shared by all the API Keys of the Account and reset every Monday at 00:00 UTC; unused requests do not carry over. Per-minute rate limits are described in the documentation. Beyond the Business plan, the Publisher provides a Quote on request (Enterprise offer).

2. Account creation and subscription

The Account is created online, free of charge. The Client confirms their e-mail address before creating an API Key. Creating the Account means accepting the Terms.

The Client subscribes to a paid plan from their dashboard. They are redirected to Stripe’s secure payment page, where they check the chosen plan, its price and their billing details, then confirm the order. Confirmation of the payment means acceptance of these Terms of Sale and concludes the contract; a receipt is sent by e-mail.

3. Prices

Prices are in euros and are the final amount charged: the Publisher is under the VAT franchise scheme (VAT not applicable, article 293 B of the French General Tax Code). The amount charged is the one shown on the payment page before it is confirmed.

The Publisher may change its prices. An increase applies to a running subscription only from the following period, after the Client is informed by e-mail at least 30 days in advance; a Client who refuses it may cancel before it takes effect.

4. Payment and renewal

  • Payment is made by card, through the payment provider Stripe. The Publisher never has access to card numbers.
  • The subscription is monthly, or yearly for the Business plan at the Client’s choice, payable in advance. It renews automatically on each anniversary date, charged to the saved payment method, until it is cancelled.
  • Invoices are available at any time from “Manage subscription” in the dashboard.

5. Failed payments

If a charge fails, Stripe retries it for a few days and the Client is asked to update their payment method; the plan stays active meanwhile. If the payment does not go through, the subscription ends and the Account returns to the Free plan, without prejudice to the sums due.

6. Changing plans

The Client changes plan at any time from “Manage subscription”. The change takes effect immediately; the price difference for the current period is prorated and invoiced at once (or credited to the next invoices when moving to a lower plan).

When moving to a lower plan, existing API Keys are kept, but the Client can only create new ones within the limit of the new plan, whose quota applies at once.

7. Cancellation

The Client cancels their subscription at any time, without fees or reason, from “Manage subscription”. Cancellation takes effect at the end of the current period (the month, or the year for a yearly subscription), already paid: the plan remains active until then, after which the Account returns to the Free plan. The period started is not refunded.

The Publisher may cancel or suspend a subscription in the cases provided for by the Terms (section 8, breaches and abuse).

8. No right of withdrawal

As the Client subscribes for business purposes, the consumer right of withdrawal does not apply. The Client may nevertheless cancel at any time under section 7.

9. Business plan commitments

For the duration of a Business subscription, the Publisher makes the following commitments:

  • Availability: the API is available 99.5% of the time over each calendar month, as measured by the Publisher with an external probe querying the API every minute, excluding maintenance announced at least 48 hours in advance and force majeure. The commitment covers access to the API, not the completeness or accuracy of the Data (section 10 of the Terms).
  • Credit: if a month’s availability falls below 99.5%, the Client obtains, on request made within 30 days after the end of that month, a credit of 10% of the monthly price for each started 0.5-point shortfall, capped at 50% of the monthly price (for a yearly subscription, the monthly price is the yearly price divided by twelve). The credit is applied to the next invoice; it is the lump-sum and exclusive compensation for a breach of this commitment.
  • Support: tickets opened from the dashboard get a first answer within one business day (Monday to Friday, excluding French public holidays).
  • Coverage: up to 10 requests a month to add or fix a cinema are handled first, provided the cinema publishes its showtimes online.

10. Complaints and governing law

Any complaint is addressed to contact@florianargaud.com or through a ticket from the dashboard; the Publisher answers as soon as possible.

These Terms of Sale are governed by French law. The French version prevails over any translation. Failing an amicable solution, any dispute is brought before the competent courts of the Publisher’s registered office, in accordance with section 14 of the Terms.
